CATAWAMPUS CONSULTING TERMS AND CONDITIONS OF SERVICE
These Terms and Conditions (“Agreement”) govern the use of services provided by Catawampus Consulting, a Pennsylvania limited liability company (LLC) with its principal place of business at 1001 State Street STE 907, Erie, PA 16501 (“Consultant”). By purchasing services through the online platform, the client (“Client”) agrees to the following terms and conditions.
1. Services Provided
The consultant will provide either virtual or in-person consultation services as described at the time of purchase. The details of the purchased service, including the consultation duration, are outlined on the checkout page.
- The consultation will focus on the Client's business needs, goals, and potential strategies.
- Additional services beyond the purchased consultation will require a separate agreement and may incur additional fees.
2. Payment Terms
The total fee for the service is payable in full at the time of purchase through the online platform. All prices are in USD.
- Additional services requested beyond the scope of the initial consultation will be billed separately at the Consultant's rate or price of service.
- All payments are non-refundable except as outlined under the Refund and Cancellation Policy below.
3. Scheduling and Delivery
After the purchase, the consultation will be scheduled based on mutual availability between the Client and Consultant. All consultations will be conducted in person (depending on the location) or virtually through a platform agreed upon (e.g., Zoom, Microsoft Teams).
- The Client is responsible for ensuring they have the required technology to participate in the virtual consultation.
- The availability of in-person consultations is at the discretion of the Consultant. Should the consultation be in person, the Consultant and the Client must both agree upon the location. Depending on the location and travel necessary, clients may be subject to a travel fee. Should a travel fee be necessary, the Client must sign a Travel fee agreement.
- If the Client needs to cancel or reschedule, they must provide at least 24 hours notice prior to the appointment start time. If the Consultant needs to travel for the consultation, the Client may be subject to paying the travel fees in full if a 24-hour notice is not provided.
4. Refund and Cancellation Policy
The following policies apply to refunds and cancellations:
- Consultation Services are non-refundable.
5. Client Responsibilities
The Client agrees to:
- Provide all necessary information, documentation, or access required for the consultation at least 48 hours prior to the scheduled time.
- Actively participate in the consultation and provide the Consultant with any required materials in a timely manner.
- Ensure access to a stable internet connection and suitable technology to complete the virtual consultation (if necessary).
6. Confidentiality
Both parties agree to keep all information exchanged during the consultation confidential. Neither party will disclose this information to any third parties without the prior written consent of the other, except as required by law.
- This confidentiality obligation survives the termination of this Agreement.
7. Limitation of Liability
To the maximum extent permitted by law, the Consultant shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities, arising out of or in connection with the services provided.
- The consultant's total liability for any claim shall be limited to the amount paid by the Client for the service.
8. Disclaimer
The services provided by the Consultant are based on information and resources available at the time of the consultation. The Consultant does not guarantee any specific outcomes or results from the consultation.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Pennsylvania, without regard to its conflict of law principles.
10. Changes to Terms
Consultant reserves the right to update or modify these Terms and Conditions at any time. Any changes will be communicated to the Client and posted on the Consultant’s website. Continued use of the services after such modifications indicates acceptance of the updated terms.
11. Force Majeure
Neither party shall be liable for delays or failures to perform due to circumstances beyond their control, including but not limited to natural disasters, technical failures, government actions, or other unforeseen events.
12. Entire Agreement
These Terms and Conditions constitute the entire agreement between the Consultant and Client with respect to the service purchased.
By purchasing and using the services provided by Catawampus Consulting, the Client acknowledges and agrees to these Terms and Conditions.
